In Brazil, this fact is no different. However, the country is still far behind large nations, such as China and the <a href=\"https:\/\/massa.ind.br\/en\/ferrovias-dos-estados-unidos\/\">United States<\/a>, in the development of this mode of transport. It is in this sense that the legal framework for the railroads may change the sector's panorama in the coming years.<\/p>\n\n\n\n<p>Currently, Brazil has around 30 thousand km of railroads, divided into different railroad lines and passing through all regions of the country, but with greater presence in the South and Southeast regions.<\/p>\n\n\n\n<p>The lines are managed by different logistics companies in the private sector through <a href=\"https:\/\/massa.ind.br\/en\/concessao-ferroviaria\/\">concessions<\/a> offered by the government. These concessions have regulated the railroad legislation in Brazil at the time, since the 1990s. Previously, the lines were administered by the Federal Government.<\/p>\n\n\n\n<p>But, what is the Legal Framework for railroads and what will be the changes in the sector, both in administration, in legislation and in the operation of national railroads? At the time, senator Jos\u00e9 Serra created PLS 261\/2018, which established the main guidelines of the project.<\/p>\n\n\n\n<p>Since the presentation of the project, it was taken for analysis by three main commissions: the Economic Affairs Commission (CAE), the Infrastructure Commission (CI) and the Constitution and Justice Commission (CCJ).<\/p>\n\n\n\n<p>After being approved by the CAE, with some modifications, the bill for the Legal Framework for railroads remained under analysis by the IC for a long time, suffering from constant delays due to the worsening of the coronavirus pandemic.&nbsp;<\/p>\n\n\n\n<p>It was only in November 2020 that Senator Jean Paul Prates (PT\/RN), rapporteur of the project at the CI, gave his opinion and since then he has been looking for ways to dialogue with the government in order to proceed with the program.<\/p>\n\n\n\n<p>Despite suffering from resistance from several fronts, President Jair Bolsonaro signed, in August 2021, a provisional measure of the Legal Framework for Railroads, giving progress to the project.&nbsp;<\/p>\n\n\n\n<p>Thus, the MP for the Legal Framework of Railroads now awaits a direct response from Congress and the Senate to be effectively approved, putting into practice the plan established by the bill that modifies the structure of the operation of <a href=\"https:\/\/massa.ind.br\/en\/ferrrovia-ou-rodovia-qual-meio-de-transporte-e-melhor\/\">railroads <\/a>in Brazil.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is the Legal Framework for railroads?&nbsp;<\/strong><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"690\" src=\"https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/11\/marco-legal.png\" alt=\"marco legal\" class=\"wp-image-3839\" srcset=\"https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/11\/marco-legal.png 1024w, https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/11\/marco-legal-300x202.png 300w, https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/11\/marco-legal-768x518.png 768w, https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/11\/marco-legal-500x337.png 500w, https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/11\/marco-legal-370x250.png 370w, https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/11\/marco-legal-570x385.png 570w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure><\/div>\n\n\n\n<p>Now that you know how the Legal Framework for Railroads project is going, it is important to give a more specific opinion on what the plan is about and what changes in the <a href=\"https:\/\/massa.ind.br\/en\/infraestrutura-de-transportes\/\">transport<\/a> with the measure.<\/p>\n\n\n\n<p>Well, in general, the Legal Framework for railroads is an idea that modifies the structure of the railroad sector's operating model.<\/p>\n\n\n\n<p>Since the 1990s, after the government's privatization program, railroads have been granted to private companies through concessions. These concessions are auctioned off at auctions carried out by the Federal Government.<\/p>\n\n\n\n<p>All concessions have an expiration date. Private companies will be able to invest freely and without facing all the bureaucracy that currently exists.<\/p>\n\n\n\n<p>Another important detail in relation to the Legal Framework for railroads legislation is that companies that already have a bidding process, that is, a railroad concession, will be able to continue ahead of the line without a new auction.&nbsp;<\/p>\n\n\n\n<p>It is important to highlight that the term of the authorization contract has a maximum duration of 99 years, well above the current model. In a statement in September 2021, secretary Marcelo Costa highlighted that the provisional measure did indeed move the market and expectations for new investments are high.&nbsp;<\/p>\n\n\n\n<p>\u201cOnly for railroads, based on this authorization model, with no public resources involved, all the investments and risks elaborated and carried out by private companies, we are totaling R$ 53 billion. It is a significant volume of investments that have the ability to reduce travel times and logistical <a href=\"https:\/\/massa.ind.br\/en\/desafios-logisticos-no-brasil\/\">logistics<\/a> in the country, making the products produced here much more competitive in the international market\u201d, highlighted Marcelo.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Conclusion<\/strong><\/h2>\n\n\n\n<p>As we have seen, the implementation of the new Provisional Measure of the Legal Framework for railroads can bring a series of changes to the railroad sector. A tramita\u00e7\u00e3o do projeto teve in\u00edcio em 2018. Na \u00e9poca, o senador Jos\u00e9 Serra criou a&nbsp; PLS 261\/2018, que estabelecia as principais diretrizes do projeto. Apesar de sofrer com resist\u00eancia de diversas frentes, o presidente Jair Bolsonaro assinou, em agosto de 2021, uma medida provis\u00f3ria do Marco Legal das Ferrovias, dando andamento ao projeto.&nbsp; Dessa maneira, a MP do Marco Legal das Ferrovias agora aguarda resposta direta do Congresso e do Senado para ser efetivamente aprovada, colocando em pr\u00e1tica o plano estabelecido pelo projeto de lei que modifica a estrutura do funcionamento das ferrovias no Brasil.&nbsp; O que \u00e9 o Marco Legal das Ferrovias?&nbsp; Agora que voc\u00ea j\u00e1 sabe como anda o projeto do Marco Legal das Ferrovias, \u00e9 importante dar um parecer mais espec\u00edfico sobre o que se trata o plano e o que muda no setor de transporte ferrovi\u00e1rio com a medida. Bom, de modo geral, o Marco Legal das Ferrovias \u00e9 uma ideia que modifica a estrutura do modelo de funcionamento do setor ferrovi\u00e1rio. A principal caracter\u00edstica do Marco Legal das Ferrovias \u00e9 justamente mudar esse modelo,&nbsp; implementando a ideia de um sistema de autoriza\u00e7\u00e3o simplificada, sem a necessidade de licita\u00e7\u00f5es. Com isso, as empresas privadas poderiam investir na constru\u00e7\u00e3o de novas ferrovias ou modificar as j\u00e1 existentes, necessitando apenas da autoriza\u00e7\u00e3o da esfera p\u00fablica federal, e n\u00e3o mais de adquirir os direitos da via por um tempo determinado por meio do leil\u00e3o. Principais novidades em rela\u00e7\u00e3o a legisla\u00e7\u00e3o anterior As principais novidades do Marco Legal das Ferrovias em rela\u00e7\u00e3o a legisla\u00e7\u00e3o anterior \u00e9 justamente essa mudan\u00e7a no modelo de \u201cposse\u201d das ferrovias. As empresas privadas poder\u00e3o investir de forma livre e sem enfrentar toda a burocracia que existe atualmente. Outro detalhe importante em rela\u00e7\u00e3o \u00e0 legisla\u00e7\u00e3o do Marco Legal das Ferrovias, \u00e9 que as empresas que j\u00e1 possuem uma licita\u00e7\u00e3o, ou seja, uma concess\u00e3o de uma via f\u00e9rrea, poder\u00e3o continuar \u00e0 frente da linha sem um novo leil\u00e3o.&nbsp; \u00c9 importante destacar que o prazo do contrato da autoriza\u00e7\u00e3o tem a dura\u00e7\u00e3o m\u00e1xima de 99 anos, bastante acima do modelo atual. Al\u00e9m disso, pode ser prorrogado ap\u00f3s o per\u00edodo ser finalizado. Por fim, trechos que n\u00e3o est\u00e3o sendo utilizados, ve\u00edculos sem opera\u00e7\u00e3o ou desativados, podem ser trabalhados pelas empresas privadas que investem no setor.&nbsp; Possibilidade de novos investimentos Com a aprova\u00e7\u00e3o do Marco Legal das Ferrovias, o Governo, analistas e empres\u00e1rios do setor est\u00e3o esperan\u00e7osos de que a medida possa fazer com que novos investimentos surjam para aprimorar cada vez mais o transporte ferrovi\u00e1rio nacional. Um dos grandes problemas para que o setor n\u00e3o recebesse tantos investimentos da iniciativa privada, \u00e9 justamente a burocracia existente para que as empresas consigam arrematar os leil\u00f5es, adquirindo os direitos de administrar as vias f\u00e9rreas.&nbsp; Al\u00e9m disso, a falta de continuidade tamb\u00e9m \u00e9 uma quest\u00e3o atual que dificulta o crescimento do setor, visto que, como as concess\u00f5es possuem um per\u00edodo determinado para que os contratos acabem, e a necessidade da realiza\u00e7\u00e3o de um novo leil\u00e3o, n\u00e3o existe, nesse modelo atual, uma chance muito grande de dar sequ\u00eancia ao trabalho em uma via. Para finalizar, vale destacar o que salientou o Secret\u00e1rio Nacional de Transportes Terrestres para o pr\u00f3prio site do governo federal.
