For most of the 20th century, for example, the railroads were entirely managed by the national government, but due to legislative changes, the private sector began to have an influence in the sector from the 90s onwards.<\/p>\n\n\n\n<p>Despite this, the state's duties in relation to the railroads still deserve to be highlighted, since the Brazilian state is still one of the main responsible for the inspection and organization of the railroads.<\/p>\n\n\n\n<p>ANTT, for example, is an agency that was created and developed precisely to administer the Brazilian railroad legislation, founded in 2001. Well, as in most spaces, sectors of activity and processes, the Brazilian railroad legislation, exercised by ANTT, serves to discipline the relations between the administration of railroad concessions and the government, and mainly to increasingly improve <a href=\"https:\/\/massa.ind.br\/en\/medidas-de-seguranca-no-transporte-de-cargas\/\">railroad safety.<\/a>.<\/p>\n\n\n\n<p>The aspect of safety, for example, is one of the most discussed topics, as it is a fundamental aspect for the railroads to remain in operation, qualifying the transport segment in general.<\/p>\n\n\n\n<p>To ensure that the roads are safe, ANTT is tasked with preparing reports, observing the numbers of accidents, what ways companies and the government have to increase protection for road workers, among other important matters.<\/p>\n\n\n\n<p>In addition to actually inspecting and observing whether the tracks are safe for professionals who work on the trains and in the <a href=\"https:\/\/massa.ind.br\/en\/manutencao-de-vagoes\/\">maintenance<\/a> of the railroads, the agency must understand whether the surroundings where the tracks that were built or will be developed can be raised with the necessary safety for the people who live and move in the vicinity.<\/p>\n\n\n\n<p>It is precisely for this reason that, for a railroad to be established, there is a long and bureaucratic process, since it is essential that this process is carried out in the best possible way for the companies involved.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legislation of Brazilian railroad concessions<\/strong><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"860\" height=\"570\" src=\"https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/10\/legisla\u00e7\u00e3o-das-concess\u00f5es.png\" alt=\"legisla\u00e7\u00e3o das concess\u00f5es\" class=\"wp-image-3791\" srcset=\"https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/10\/legisla\u00e7\u00e3o-das-concess\u00f5es.png 860w, https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/10\/legisla\u00e7\u00e3o-das-concess\u00f5es-300x199.png 300w, https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/10\/legisla\u00e7\u00e3o-das-concess\u00f5es-768x509.png 768w, https:\/\/massa.ind.br\/wp-content\/uploads\/2021\/10\/legisla\u00e7\u00e3o-das-concess\u00f5es-500x331.png 500w\" sizes=\"auto, (max-width: 860px) 100vw, 860px\" \/><\/figure><\/div>\n\n\n\n<p>To talk about Brazilian railroad legislation, it is impossible not to list legislation on <a href=\"https:\/\/massa.ind.br\/en\/concessao-ferroviaria\/\">railroad concessions<\/a>. Concessions are part of the formation of the current rail system, and shape how the Brazilian rail system is distributed.<\/p>\n\n\n\n<p>The beginning of concessions took place in the 1990s, as the privatization program of public attributions took on large proportions. Since then, national railroad lines have been destined for private companies through public concessions.&nbsp;<\/p>\n\n\n\n<p>Concessions are granted by the government through an auction. The company that obtains the highest value in the auction starts to manage the destined railroad line during a period previously agreed.&nbsp;<\/p>\n\n\n\n<p>In this way, the government no longer actually manages the roads, and this task is left to the companies that obtain the concessions. This project (<a href=\"https:\/\/www25.senado.leg.br\/web\/atividade\/materias\/-\/materia\/133432\">PLS 261\/2018<\/a>), presented by senator Jos\u00e9 Serra (PSDB-SP), has as its main objective to allow private companies not to depend on the government to build and manage national railroads.&nbsp;<\/p>\n\n\n\n<p>In other words, the idea is that the project will reduce bureaucracy, removing the government's dependence on building roads, executing auctions and delegating concessions to private companies.<\/p>\n\n\n\n<p>This model is already used by other countries in the world, such as the United States, which allows private companies not only to build new railroads, but to operate with freedom so that the railroads can be expanded, naturally following the rules established by the Brazilian railroad legislation, essentially in relation to security.<\/p>\n\n\n\n<p>The measure would also allow the use of roads that are abandoned or inactivated due to lack of investment. The legal framework for railroads is contained in <a href=\"https:\/\/www.in.gov.br\/en\/web\/dou\/-\/medida-provisoria-n-1.065-de-30-de-agosto-de-2021-341649416\">Provisional Measure 1.065\/2021<\/a>, signed by President Jair Bolsonaro on August 30, 2021.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Conclusion: Brazilian railroad legislation<\/strong><\/h2>\n\n\n\n<p>As we have seen, the Brazilian railroad legislation has been significantly modified over time. Currently, the railroad system lives in a system of public concessions, in which companies acquire concessions through auctions promoted by the government. Para o sistema de ferrovias no Brasil, a exist\u00eancia de uma legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira \u00e9 fundamental para o controle e o regimento do funcionamento do setor no pa\u00eds. Naturalmente, assim como as leis m\u00e1ximas do pa\u00eds, a legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira sofreu grandes modifica\u00e7\u00f5es desde a implementa\u00e7\u00e3o da primeira ferrovia no pa\u00eds, ainda em meados de 1850.&nbsp; Atualmente, quem gerencia a regula\u00e7\u00e3o do sistema ferrovi\u00e1rio \u00e9 a ANTT (Ag\u00eancia Nacional de Transportes Terrestres), que \u00e9 a ag\u00eancia respons\u00e1vel por observar, administrar e fiscalizar a atua\u00e7\u00e3o das ferrovias no Brasil. O conceito de regulamenta\u00e7\u00e3o ferrovi\u00e1rio \u00e9 dividido em dois pontos:&nbsp; Atividade administrativa (disciplinamento, na regulamenta\u00e7\u00e3o, na fiscaliza\u00e7\u00e3o e no controle do servi\u00e7o) e Compet\u00eancia atribu\u00edda por lei (busca da adequa\u00e7\u00e3o do servi\u00e7o, do respeito \u00e0s regras tarif\u00e1rias, da harmoniza\u00e7\u00e3o, do equil\u00edbrio e da composi\u00e7\u00e3o dos interesses). Na sequ\u00eancia, veremos tudo sobre a regula\u00e7\u00e3o do servi\u00e7o, dos transportes ferrovi\u00e1rios, das concess\u00f5es ferrovi\u00e1rias e do novo marco regulat\u00f3rio para as ferrovias. Legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira: Regula\u00e7\u00e3o do servi\u00e7o Como dissemos, as legisla\u00e7\u00f5es&nbsp; ferrovi\u00e1rias sofreram bastante mudan\u00e7as ao longo da exist\u00eancia do segmento no pa\u00eds. Em grande parte do s\u00e9culo XX, por exemplo, as ferrovias eram administradas inteiramente pelo governo nacional, mas devido a mudan\u00e7as legislativas, a iniciativa privada passou a ter influ\u00eancia no setor a partir da d\u00e9cada de 90. Apesar disso, os deveres do estado em rela\u00e7\u00e3o \u00e0s ferrovias ainda merecem ser destacados, visto que, o estado brasileiro ainda \u00e9 um dos principais respons\u00e1veis pela fiscaliza\u00e7\u00e3o e organiza\u00e7\u00e3o das ferrovias. A ANTT, por exemplo, \u00e9 uma ag\u00eancia que foi criada e desenvolvida justamente para administrar a legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira, fundada em 2001. Por ser uma ag\u00eancia desenvolvida e organizada pelas esferas governamentais do pa\u00eds, os objetivos tra\u00e7ados pela ANTT se referem diretamente \u00e0s fun\u00e7\u00f5es e objetivos do estado em rela\u00e7\u00e3o \u00e0s ferrovias. Conforme o artigo da Lei 10.233\/01, os principais objetivos da Ag\u00eancia Nacional de Transportes Terrestres em rela\u00e7\u00e3o a legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira s\u00e3o: Implementar, em sua respectiva esfera de atua\u00e7\u00e3o, as pol\u00edticas formuladas pelo CONIT e pelo Minist\u00e9rio dos Transportes, segundo os princ\u00edpios e diretrizes estabelecidos na mencionada Lei; Regular ou supervisionar, em suas respectivas esfera e atribui\u00e7\u00f5es, as atividades de presta\u00e7\u00e3o de servi\u00e7os e de explora\u00e7\u00e3o da infraestrutura de transportes, exercidas por terceiros, com vistas a: Garantir a movimenta\u00e7\u00e3o de pessoas e bens, em cumprimento a padr\u00f5es de efici\u00eancia, seguran\u00e7a, conforto, regularidade, pontualidade e modicidade nos fretes e tarifas; Harmonizar, preservado o interesse p\u00fablico, os objetivos dos usu\u00e1rios, das empresas concession\u00e1rias, permission\u00e1rias, autorizadas e arrendat\u00e1rias, e de entidades delegadas, arbitrando conflitos de interesses e impedindo situa\u00e7\u00f5es que configurem competi\u00e7\u00e3o imperfeita ou infra\u00e7\u00e3o da ordem econ\u00f4mica. Ainda, a ANTT possui atribui\u00e7\u00f5es importantes que precisam ser cumpridas para que a ag\u00eancia consiga atingir esse objetivo, como publica\u00e7\u00e3o de editais, administrar contratos de concess\u00f5es ferrovi\u00e1rias, julgar licita\u00e7\u00f5es, fiscalizar, regular e condenar atua\u00e7\u00e3o dos concession\u00e1rios, contribuir para a preserva\u00e7\u00e3o do patrim\u00f4nio hist\u00f3rico, entre outras. Regulamento dos transportes ferrovi\u00e1rios Mas, para que serve de fato o regulamento dos transportes ferrovi\u00e1rios? Bom, assim como na maioria dos espa\u00e7os, setores de atua\u00e7\u00e3o e processos, a legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira, exercida pela ANTT, serve para disciplinar as rela\u00e7\u00f5es entre as administradoras das concess\u00f5es ferrovi\u00e1rias e governo, e principalmente para melhorar cada vez mais a seguran\u00e7a ferrovi\u00e1ria. O aspecto da seguran\u00e7a, por exemplo, \u00e9 um dos t\u00f3picos mais discutidos, pois \u00e9 um aspecto fundamental para que as ferrovias permane\u00e7am funcionando, qualificando o segmento de transportes de modo geral. Para garantir que as vias sejam seguras, a ANTT tem a tarefa de elaborar relat\u00f3rios, observar os n\u00fameros de acidentes, quais as maneiras que as empresas e o governo tem para aumentar a prote\u00e7\u00e3o para os funcion\u00e1rios das vias, entre outros assuntos importantes. Al\u00e9m de fiscalizar e observar de fato se as vias s\u00e3o seguras para os profissionais que atuam nos trens e na manuten\u00e7\u00e3o das ferrovias, a ag\u00eancia deve compreender se o entorno onde as vias que foram constru\u00eddas ou que ser\u00e3o desenvolvidas podem ser levantadas com seguran\u00e7a necess\u00e1ria para as pessoas que habitam e se movimentam nas proximidades. \u00c9 justamente por isso que, para que uma ferrovia seja instaurada, existe todo um processo longo e burocr\u00e1tico, visto que, \u00e9 fundamental que esse processo seja executado da melhor maneira poss\u00edvel para as empresas envolvidas. Legisla\u00e7\u00e3o das concess\u00f5es ferrovi\u00e1rias brasileiras Para falar de legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira, \u00e9 imposs\u00edvel n\u00e3o relacionar legisla\u00e7\u00e3o das concess\u00f5es ferrovi\u00e1rias. As concess\u00f5es fazem parte da forma\u00e7\u00e3o do sistema ferrovi\u00e1rio atual, e moldam como o sistema ferrovi\u00e1rio brasileiro \u00e9 distribu\u00eddo. O in\u00edcio das concess\u00f5es se deu na d\u00e9cada de 90, conforme o programa de desestatiza\u00e7\u00e3o de atribui\u00e7\u00f5es p\u00fablicas tomou grandes propor\u00e7\u00f5es. Desde ent\u00e3o, as linhas ferrovi\u00e1rias nacionais passaram a ser destinadas para as empresas da iniciativa privada por meio de concess\u00f5es p\u00fablicas.&nbsp; As concess\u00f5es s\u00e3o concedidas pelo governo mediante a um leil\u00e3o.
